BRS leader and former Chief Minister K. Chandrasekahar Rao along with his nephew and former Cabinet colleague T. Harish Rao approached the High Court seeking a direction to quash an order passed by Jayashankar Bhupalpally Principal Sessions Judge allowing a criminal revision petition against them.
The criminal petition filed by them is yet to be heard. They also wanted the HC to suspend the PSJ order till the disposal of the criminal petition.
Forty-six-year-old Nagavelli Rajalingamurthy of Jayashnakar Bhupalpally district filed a private complaint with the Junior Principal Civil Judge-cum-Judicial Magistrate of First Class of the district. In this private complaint, the petitioner arrayed the former CM and the former Minister as first and second accused respectively.
He wanted a direction to the local police to register a case against them under different sections of the Indian Penal Code, including 120-B (criminal conspiracy). The Magistrate on January 12, 2024 dismissed the complaint on the ground that it did not have jurisdiction to pass order in the matter.
Challenging this, the farmer filed a Criminal Revision Petition before the PSJ. After considering the objections raised by the Registry, the PSJ held that the petition was maintainable. He instructed the Registry to register the petition.
Questioning this direction, the two petitioners knocked the doors of the HC by filing a criminal petition seeking quashing of the same.
