4 of a family killed, ten injured, in road mishap in Sri Sathya Sai district

In a gory road mishap, four persons of the same family were killed on the spot, and ten others received grievous injuries, four of them critically, when a 12-seater tempo vehicle collided with a parked lorry at Bullasamudram village of Madakasira mandal of Sri Sathya Sai district on the NH-44 in the early hours of Saturday (December 21, 2024).

According to the Madakasira police, a group of people from a village from K.N. Palle village of Gudibanda mandal of the district were returning from Tirumala after darshan. Around 5:30 a.m., their vehicle hit the rear of a parked lorry at a high speed. Ironically, their native place was about 40 km from the accident site.

The deceased were identified as Ratnamma (69), her daughter Prem Kumari (30), her son-in-law Manoj (30 – driver), and her granddaughter Antarva (2).

The ten injured, all related to each other, were rushed to the Government Hospital at Madakasira and were later shifted to private hospitals in Hindupur and Bengaluru. Four of them were said to be in critical condition.

The police suspect that the driver might have caused the accident due to sleepiness.

Minister S. Savitha, who hails from Sri Sathya Sai district, spoke to the police and district officials about the accident and directed the concerned officials to extend quality medical care to the injured.

Superintendent of Police V. Ratna and senior police officials rushed to the spot and later called on the injured at the hospital in Madakasira.

The police registered a case and took up further investigation.

Private airline IndiGo began its first Chennai-Penang flight on Saturday (December 21, 2024), with 165 passengers on board the 3.5-hour service that left Chennai at 2.15 a.m.

An aviation source, who is associated with the launch, said the daily flight will have connections with 38 cities across India. It is also being marketed as a Madurai-Penang service (6E7253/7515), with the connecting point at Chennai, and passengers having a through connection. A 78-seat ATR-72 will operate on the Madurai-Chennai sector, landing in the city at 10.25 p.m., while a 186-seat A320N will fly the Chennai-Penang sector (6E1045/1046). Saturday’s flight had 20 passengers connecting from Madurai.

The official said Penang has a historical link with Madurai and the airline is expecting passenger feed from Madurai, Tenkasi, Ramanathapuram, Sivakasi, and Karaikudi. With Penang as a gateway to north Malaysia, the airline will cater to leisure traffic, visiting friends and relatives (VFR), the trader community, and religious tourism (Sabarimala). The State, which is a four-hour drive from Kuala Lumpur, is a major electronics hub — Lenovo and Dell have centres there — and the airline will serve corporate traffic.

He said some passengers could take the ferry service from Penang to Langkawi and connect to the airline’s Langkawi-Bengaluru flight. He said the airline has strengthened its air links between South India and Malaysia, with A320 flights on the Chennai-Kuala Lumpur (daily), Bengaluru-Kuala Lumpur, Bengaluru-Langkawi, and now, Chennai-Penang sectors.

Eight years down the line, Kalaburagi branch of Jayadeva Heart Institute gets dedicated building of 371 bed-capacity

Kalaburagi

The stage is set for the inauguration of a state-of-the-art building to house the Kalaburagi branch of the Sri Jayadeva Institute of Cardiovascular Sciences and Research (SJICSR). This 371-bed facility, constructed at a cost of ₹327.17 crores funded by the Kalyana Karnataka Region Development Board (KKRDB), is scheduled to be inaugurated by Chief Minister Siddaramaiah on Sunday (December 22, 2024).

Congress president and Leader of Opposition in Rajya Sabha, Mallikarjun Kharge, will inaugurate the Outpatient Department, while Deputy Chief Minister D.K. Shivakumar, District In-charge Minister Priyank Kharge and Medical Education Minister Sharan Prakash Patil will respectively inaugurate the Intensive Care Unit, Operation Theatre Complex, and catheterization laboratory facilities.

Inception in 2016

The groundwork for establishing a branch of this premier heart institute in Kalaburagi began in 2013 under the Congress government led by Chief Minister Siddaramaiah. Medical Education Minister Sharan Prakash Patil, who hailed from Kalaburagi district, kept pushing for the SJICSR unit, the autonomous institute functioning under his own department. Dr. C.N. Manjunath, the then Director of SJICSR (now Lok Sabha member from Bengaluru Rural) was also keen on taking his institute’s world-class heart care services beyond Bengaluru, especially to the backward Kalyana Karnataka region. Their efforts culminated in the inauguration of a 100-bed facility on April 23, 2016, by Mr. Siddaramaiah. This facility operated on the third floor of the Gulbarga Institute of Medical Sciences (GIMS) for eight years.

The SJICSR branch in Kalaburagi brought world-class heart care to the region, saving countless lives in the Kalyana Karnataka region. In its eight years of operation, the unit treated around 5.75 lakh outpatients, including 18,550 children, and offered inpatient services to 47,500 individuals. Procedures included 25,000 angiograms, 13,000 angioplasties, and 300 pacemaker implants. Additionally, the unit conducted 3.92 lakh ECGs, 2.14 lakh echocardiograms, and 53,399 X-rays. The numbers themselves speak volumes about the immense need of a heart facility in the region.

Expansion and new building

Recognizing the growing demand, civil society organizations like the Kalyana Karnataka Chamber of Commerce and Industry joined local politicians in pressing for the expansion of the SJICSR branch. Their persistence led to its inclusion in the 2019-20 budget by the coalition government of Janata Dal (Secular) and Congress. Then Chief Minister H.D. Kumaraswamy announced plans for a 300-bed facility, to be built on 7.10 acres of prime land in the heart of the city belonging to the Department of Health and Family Welfare at a cost of ₹150 crores funded by KKRDB.

Mr. Kumaraswamy, did not, however, allocate any funds from the general budget but stated but stated that the Hyderabad Karnataka Region Development Board (now Kalyana Karnataka Region Development Board) would provide the funds. Civil society activists and organisations criticised this funding arrangement. They argued that the government should provide funds for such projects from the general budget, just as it did with other projects sectioned to other regions, and not from KKRDB funds which were received as special grants by virtue of Article 371(J) of the Constitution and meant for combating regional imbalances. The criticism apparently had no significant effect on anyone, including Congress leaders who held the same opinion.

Despite the criticism, progress continued under subsequent governments. B.S. Yediyurappa, who became Chief Minister in July 2019, laid the foundation stone for the new facility on September 17, 2020, when he came to Kalaburagi to hoist the national flag to mark Kalyana Karnataka Liberation Day celebrations.

Revised plan and modern facilities

Although the COVID-19 pandemic temporarily delayed the project, it gained momentum after Congress came to power in 2023 and Mr. Siddaramaiah assumed office as Chief Minister for the second time. Mr. Patil came back as Medical Education Minister, and Mr. Priyank resumed office as Kalaburagi In-charge in the Siddaramaiah cabinet to push the project.

To commemorate the 10th anniversary of the region’s special status under Article 371(J), the facility’s capacity was expanded to 371 beds, increasing the project’s cost to ₹327.17 crores, of which ₹302 crores were funded by KKRDB and the rest by SJICSR from its own funds.

The new hospital features cutting-edge infrastructure, including three Cath Labs, three Operation Theatres, a Hybrid Operation Theatre, 105 ICU beds, 120 general ward beds, and 24 recovery and post-operative beds. It offers specialised services in cardiology, cardiothoracic and vascular surgery, paediatric cardiology, radiology, 128-slice CT scanning, 1.5T MRI, ultrasonography, hematopathology, and blood banking. This facility aims to deliver world-class cardiac care to the unprivileged population of the Kalyana Karnataka region.

No long-term environmental harm in Ennore due to CPCL oil spill, says Union govt.

The Ministry of Petroleum and Natural Gas on Friday (December 20, 2024) said that Chennai Petroleum Corporation Limited (CPCL) had taken significant steps to address the environmental damage caused by the oil spill in Ennore, in December 2023.  

In response to a question raised by Lok Sabha MP Dayanidhi Maran, Suresh Gopi, Minister of State for Petroleum and Natural Gas, stated that CPCL has installed permanent booms along the Buckingham Canal to contain any potential oil spread in the future. He said that an Environmental Impact Assessment by The Energy and Resources Institute found no significant long-term environmental damage due to the incident. 

Mr. Maran’s questions included actions being taken by CPCL to restore the affected ecosystems, particularly the mangroves and wetlands, and whether the company had a disaster management plan in place to prevent such incidents in the future. He also sought clarification on CPCL’s transparency in the remediation process and whether it had complied with the directives issued by the Tamil Nadu Pollution Control Board (TNPCB) and the National Green Tribunal (NGT). 

As per the response, CPCL has complied with the directives issued by the TNPCB, including installation of an Online Continuous Emission Monitoring System (OCEMS) at various locations within its operations to ensure pollutants are kept in check. This system monitors key pollutant parameters, including pH, Total Suspended Solids, Total Dissolved Solids, and oil grease, at the outlet of stormwater ponds.  

CPCL, in collaboration with the Tamil Nadu government, the Tamil Nadu Forest Department, and the TNPCB, has undertaken various restoration activities, Mr. Gopi said. These include the use of herbal nano bio-dispersants for bioremediation of mangrove areas, based on advice from the National Institute of Oceanography, Goa. The company has been providing daily updates to State authorities, and the comprehensive EIA concluded there was no significant environmental impact from the spill. 

Updated disaster management framework 

CPCL has a comprehensive Emergency Response and Disaster Management Plan (ERDMP), which was revised in 2024, aimed at preventing similar incidents in the future. As part of efforts to address socio-economic damage, CPCL deposited ₹7.53 crore in compensation, as directed by the Tamil Nadu Revenue Administration. However, a show-cause notice was issued to CPCL by the TNPCB in November 2024, and the matter is currently under review by the NGT.

People’s Democratic Party (PDP) supremo Mehbooba Mufti on Saturday (December 21, 2024) said the proposed increase in GST for Kashmiri shawl would finish the craft and appealed to Jammu and Kashmir Chief Minister Omar Abdullah to address the issue.

She also alleged that the Centre was trying to make the people of Jammu and Kashmir dependent solely on tourism.

“The Kashmiri shawl is not just a means of livelihood for us but an identity of Jammu and Kashmir. It is famous all over the world. The (previous) National Conference government banned the Shahtoosh, which was our heritage. That also caused economic losses,” Ms. Mehbooba told reporters.

“Today, when you increase GST on Kashmiri shawl to 28%, our art will automatically die,” the PDP president added.

The former Chief Minister of the erstwhile State alleged efforts were being made to destroy Jammu and Kashmir by undertaking development work on horticulture land and imposing GST on the handicraft sector.

“These kept Jammu and Kashmir alive in its difficult times. I request Omar [Abdullah] that these are our assets, you have 50 MLAs, three MPs, for God’s sake, tell us what you are doing to save our assets. What are you doing on the issue of increasing GST to 28%,” she asked.

The PDP chief alleged that these measures were an attempt by the Centre to make Jammu and Kashmir dependent solely on tourism.

“If our horticulture and handicraft are finished, we will only be dependent on tourism. Perhaps, the Central Government wants to finish the horticulture and the handicraft sectors to make the people of Jammu and Kashmir dependent only on tourism so that when they can send tourists whenever they want,” Ms. Mehbooba said.

She also claimed huge development projects were wreaking havoc on agricultural and horticultural land.

The PDP supremo said, “Railway lines, ring roads, the Baramulla-Rajouri highway — there is an onslaught on orchards through which youngsters earn their livelihood. It can have a very bad impact on Jammu and Kashmir’s economy and our situation can become worse than those States from where labourers come here. So, Omar [Abdullah] should pay special attention — our lands are being taken away for huge projects.” She also urged the Chief Minister to provide clarity on the people being settled in the 30 satellite townships being built in the valley.

“Thirty satellite townships are being built, 1.20 lakh land is needed for those. He [Omar Abdullah] should tell us for whom those are being built. Who are being settled there? There are apprehensions about who are being settled as there are examples around the world like in Gaza and Syria where people’s land was snatched,” Ms. Mehbooba said.

“The people of Jammu and Kashmir are already reeling from uncertainty. There was no need to build these townships. Our agricultural land is being taken for those,” she further said.

The PDP chief also claimed around 1.5 lakh ration cards of people below the poverty line were cancelled in Jammu and Kashmir. “People are facing hardship owing to the intense cold and problems in electricity supply have added to their misery,” she said.

Ms. Mehbooba expressed hope that Chief Minister Abdullah would pay attention to these issues and resolve the people’s problems.

Jaipur-Ajmer highway truck fire: Experts blame incomplete construction, sudden cuts; seek road safety action plan

Incomplete construction, sudden cuts and a lack of traffic sense might have caused the Jaipur-Ajmer highway accident that killed 14 people, experts said on Saturday and called for a comprehensive statewide road safety action plan.

They also attributed the absence of proper signages and road markings for the accident.

“The stretch of the Jaipur-Ajmer highway where the crash occurred is an accident-prone spot, with poor traffic management and ongoing construction creating hazardous conditions,” said George Cheriyan, a prominent voice of Road Safety Network in India and a former member of the Rajasthan chief secretary’s traffic management committee.

He said physical measures should have been in place to prevent big tankers from making u-turns on the highway.

It is difficult to apply brakes when moving at high speeds, Cheriyan said.

An LPG tanker collided with a truck on Friday, sparking a massive fireball that turned a stretch of the Jaipur-Ajmer highway into an inferno in which 14 people died and nearly 40 vehicles were engulfed in flames.

More than 30 people who suffered burn injuries in the massive crash are undergoing treatment.

Cheriyan said road accidents in Rajasthan surged by 13% points in 2022, accompanied by an 11% point increase in fatalities.

The data, released by Rajasthan’s department of transport and road safety, showed that the number of accidents rose to 23,614 in 2022 compared to 20,951 in the previous year.

Rajasthan was also among the six large states that accounted for nearly 55% of the 1,73,000 (1.73 lakh) road accident deaths in the country in 2023. It recorded the sharpest increase in fatalities among them, with an almost six percentage point rise from 2022, according to data shared by state governments with the Centre.

According to Cheriyan, the continuing trend of such road accidents in Rajasthan called for a comprehensive statewide action on road safety for 2025 to 2030.

Bagru Udhyog Mitra co-convenor Navneet Jhalani, who passes the accident spot daily, said, “The foundation of Friday’s accident was laid when the ring road was hastily inaugurated six years ago to bypass the implementation of the Model Code of Conduct for elections. A cloverleaf interchange had to be constructed on the busy highway but it is still pending.” He added that they submitted several several memoranda to the National Highways Authority of India regarding this.

Road safety expert Dr Prerna Arora Singh said, “There is no high mast lighting system at the intersection. Visibility becomes very low during winters. There is no radium, reflector or signal marker of any kind at the cut.” She also said the width of the cut at the intersection was too narrow.

“If a big truck such as a container or gas tanker passes through, it blocks the road on both sides. This could possibly be the reason for the accident,” Singh said.

She also said there was a lack of road traffic sense among people that needed to be improved through interventions.

Talking to reporters after meeting the accident victims at Sawai Man Singh Hospital, Congress leader Sachin Pilot also highlighted several shortcomings and demanded a probe.

“We all know about the accident spot. Why was construction not completed? Who is the contractor and agency? We need to know the facts after a detailed probe,” he said.

Pilot also said that accidents were rising with the increase in the number of vehicles in the country.

“Governments will have to seriously think whether safety norms are being followed,” he said.

The Maharashtra legislative assembly was prorogued on Saturday (December 21, 2024) after the end of the winter session.

The Budget session of the Maharashtra legislature will commence in Mumbai on March 3.

The prorogation order issued by Maharashtra Governor C P Radhakrishnan was read out by Speaker Rahul Narwekar.

The six-day winter session witnessed uproar over Union Home Minister Amit Shah’s remarks on B R Ambedkar, violence in Parbhani city in central Maharashtra over the desecration of a replica of the Constitution, and the murder of a sarpanch in Beed.

Madras High Court restrains U.S. citizen from proceeding with divorce plea filed in Washington

The Madras High Court has restrained an American citizen from proceeding with a divorce case filed by her before the King County Superior Court in Washington, United States, and also from initiating any kind of legal proceedings related to her marriage before the courts in Singapore.

Justice V. Lakshminarayanan granted the anti-suit injunction after agreeing with her husband, an Indian citizen, that the Family Court in Chennai would be the right forum to decide on the matrimonial dispute between the couple, who got married in 2013 under the Special Marriage Act of 1954.

After their wedding, the couple had relocated to the United States and had a child in 2016. In 2023, they relocated to Singapore and in 2024, the woman lodged a complaint accusing her husband of assault. Shortly thereafter, he flew down to India and sought divorce on the grounds of cruelty and adultery.

The woman was made one of the respondents to the divorce petition filed before the Family Court in Chennai on September 4, 2024. On September 6, 2024, she too filed a divorce petition before the Washington court though she was residing with her child in Singapore then.

An e-mail written by her to the American Citizen Services at the U.S. embassy in Singapore, seeking a passport for her child, referred to the divorce petition filed by her estranged husband in Chennai and stated that “she needs to submit herself before the courts in India” in order to prevent an ex parte order, the judge pointed out.

On the contrary, she flew to San Francisco with the child on October 14, 2024, just a day before the husband could obtain an injunction order from a court in Singapore restraining her from moving the child outside Singapore. After flying to the U.S., she began pursuing her divorce plea filed in Washington.

Anti-suit injunction application

The husband then moved an anti-suit injunction application before the Family Court in Chennai. When no orders were passed on that application, he filed a civil revision petition before the High Court seeking a direction to the Family Court to dispose of his divorce plea within six months.

The judge said that a direction simpliciter to dispose of the divorce plea at the earliest, without granting any interim relief, might lead to a situation of fait accompli if the petitioner’s estranged wife continues to prosecute the matrimonial disputes before the courts in Washington or Singapore.

Asserting that the power of the High Court, to have superintendence over all trial courts, under Article 227 of the Constitution was very wide, the judge suo motu ordered the transfer of the anti-suit injunction application from the Family Court to the High Court, and allowed it.

Justice Lakshminarayanan agreed with the petitioner’s counsel Geetha Luthra, assisted by Deepika Murali and K. Harishankar, that even if the King County Superior Court at Washington grants divorce at the woman’s instance, it would not be recognised by the courts in India.

Grounds for divorce under SMA

The judge pointed out that the divorce plea before the Washington court had been filed on the ground that the marriage had broken down irretrievably though no such ground finds a place under the provisions of the Special Marriage Act of 1954 for grant of divorce.

“Any decree obtained by invoking that ground will not be recognised in India, which would result in the wasteful expenditure for the parties to continue the litigation in Washington. If divorce is granted in U.S. and the first respondent (petitioner’s wife) were to remarry and subsequently, the courts in India were to refuse to recognise the decree, the consequences will be disastrous,” the judge wrote.

He also said, though Singapore would have been the best place to file the divorce proceedings from the point of view of convenience of both parties, such a plea could not be filed over there due to the legal requirement that the couple must have resided in that country for at least three years.

‘Complete trial by Sept. 2025’

Since the marriage had been solemnised at Villivakkam in Chennai and all evidence as well as witnesses required for the conduct of the trial in the divorce plea were here, the judge directed the Family Court in Chennai to proceed with the trial and complete it before September 30, 2025.

Taking note that the petitioner was a man of means, the judge directed him to pay 30,000 Singapore dollars a month towards maintenance from September 2024 till the disposal of the divorce case. He was also ordered to pay a lump sum of ₹10 lakh towards her litigation expenses.

After making it clear that the Family Court should not insist on physical presence of the woman and permit her to appear through video conference for counselling as well as trial, the judge said, the petitioner must provide her, and the child, business class flight tickets and five-star accommodation if they have to appear in person.
