GUWAHATI

The tiger population in western Assam’s Manas National Park, a major wildlife preserve stretching into Bhutan, tripled from 2011 to 2019, a new study has said.

The report published in the latest issue of the Journal of Biological Conservation attributed this turnaround in a park that suffered because of prolonged armed conflict to increased funding, improved protection infrastructure, and a larger staff.

The study said the growth in the 500 sq. km Manas was supported by tourism revenue, which bolstered management budgets. The findings indicated that collaborative efforts from local communities, government, and conservation agencies can lead to successful species recovery in post-conflict scenarios.

“However, challenges like poaching and habitat loss persist, emphasising the need for continuous management focus as tiger populations approach their carrying capacity,” the report said.

Dipankar Lahkar of Aaranyak, an Assam-based biodiversity conservation organisation, is the lead author of the report. The co-authors are Aaranyak’s M. Firoz Ahmed, Ramie H. Begum of Assam University (Diphu campus), Sunit Kumar Das of WWF-India, former park managers Hiranya Kumar Sarma and Anindya Swargowari, former Wildlife Institute of India Dean Y.V. Jhala, independent researcher Imran Samad, and Abhishek Harihar, director of Tiger Program of Panthera.

“A factor behind the remarkable recovery of the tiger population in Manas in a post-conflict context is the extensive and interconnected forest areas in the India-Bhutan region,” Mr Ahmed said.

Mr Swargowari, a retired Indian Forest Service officer, emphasised the vital role of civil society organisations, grassroots conservation initiatives, and tourism organisations apart from cross-border collaboration in the “impressive resurgence” of the tiger.

The report said that during 2015-2022, international agencies such as Panthera and US Fish and Wildlife Services invested considerable resources and efforts alongside the local communities and park management, helping “dent the scenario of people depending highly on the natural resources” of the park.

“By training the park staff in improved and informed patrol tactics and communities on alternative and sustainable livelihoods, park entry by dependent people went down drastically over the last 10 years as most of those were able to achieve livelihood goals in and around their houses or villages,” the report said.

According to the study, the tiger population (adults/100 km2) density in Manas increased from 1.06 in 2011–12 to 3.64 in 2018–19 and has a high potential to grow to 8 or more. It added that the increasing trend could see the number of tigers in the park double by 2023 if conservation measures are in place and effective.

In 2021, a total of 44 adult tigers were photographed in Manas, one of Assam’s two tiger reserves designated as UNESCO World Heritage Sites. The other is Kaziranga National Park. EOM

Maharashtra Minister Chhagan Bhujbal on Friday denied reports that he had joined the BJP-led alliance due to pressure from the Enforcement Directorate (ED). He also denied reports that he was being targeted as he was an Other Backward Class (OBC) leader. While speaking to reporters in Nasik on Friday, he said he was yet to read the book by a renowned journalist that had made such claims. “I will go through it along with my lawyers and will take appropriate legal action if anything wrong was published,” he said.

The controversy broke out on Friday when some media outlets reported about a book in which the Minister had allegedly made such an admission.

“It was only for the benefit and progress of Maharashtra that 54 MLAs including me took this decision. We joined the NCP-Ajit Pawar faction on the plank of development, and my people are very happy with the work that has been done in my constituency,” he told reporters.

He denied writing any book or giving interviews in this regard. “I am not scared of going to prison. I haven’t said anything that has been reported. I had received a clean chit in the Maharashtra Sadan case when I was Minister in the Uddhav Thackeray government. So there is no question of being under stress for that,” he said.

He said not all 54 MLAs were facing ED investigations, and yet they took the call for the sake of development. Deputy Chief Minister Ajit Pawar also refuted the media reports.

Andhra Pradesh Chief Minister N. Chandrababu Naidu launched a seaplane demonstration, jointly organised by the Ministry of Civil Aviation and A.P. Tourism Development Corporation (APTDC), at Punnami Ghat on the banks of Krishna River here on Saturday (November 09) by flying in a SpiceJet operated De Havilland amphibious plane, built by DH-Canada, to Srisailam.

This set the stage for the commencement of commercial seaplane services by SpiceJet in Andhra Pradesh starting with Vijayawada-Hyderabad and Vijayawada-Nagarjuna Sagar routes by March 2025. Addressing the gathering, Mr. Chandrababu Naidu said the future belongs to tourism and that seaplanes would give a major fillip to the sector and promised to extend all possible support to making the State a hub for seaplane operations, while stating that the government was according industry status to tourism in the upcoming policy to take it to the next level.

He observed that A.P. has several tourist attractions in the country like Srisailam, Konaseema, and Gandikota in Kadapa district, which was considered the Grand Canyon of India, that have tremendous potential but access to which was not easy. Seaplanes would enable the tourists to reach them in far less time than what was possible with conventional means of travel (road and rail). 

Mr. Chandrababu Naidu said he requested Mr. Rammohan Naidu to help operate at least 10 seaplanes in the State, including one or two in Vijayawada, in the coming five years and that he was appreciative of the fact that the Ministry of Civil Aviation (MoCA) has revised the guidelines for seaplane operations in order to make it a thriving business proposition. 

The tourism policy was so drafted to realise the potential of the multiple places of tourist attraction in the State, he said and stressed the need for good hotels and transport services and the importance of maintaining law and order at such sites, the CM added.

Mr. Rammohan Naidu said seaplane operations were started in the country a few years ago but the COVID-19 pandemic and some other extraneous factors stifled them. Keeping in view their potential, the MoCA has recently made seaplane operations easier by issuing revised guidelines under the Regional Connectivity Scheme — Udan, with due focus on aspects like safety and licensing.

Minister for R&B and Infrastructure and Investments B.C. Janardhan Reddy and Minister for Tourism Kandula Durgesh, Vijayawada MP Kesineni Sivanath, MoCA Joint Secretary Asangba Chuba Ao and DH-Canada Regional Vice-President of Sales (Asia Pacific & Middle East) Yogesh Garg was among those present.

Veteran Bharatiya Janata Party leader Kirodi Lal Meena, who has resigned from the Rajasthan Cabinet, is at the centre of attraction at the Dausa Assembly seat going to bypoll on November 13, as his brother faces a tough challenge from the Opposition Congress. BJP candidate Jagmohan Meena has the onerous responsibility to save the reputation of his elder brother.

Congress leader and former Deputy Chief Minister Sachin Pilot, who has joined the election campaign, has made the fight tough for the Meena brothers by highlighting the BJP’s negative attitude towards farmers and agrarian crisis. “This byelection will fix the BJP government’s accountability and decide the direction of Rajasthan’s politics,” Mr. Pilot said at an election meeting in Kundal village earlier this week.

Dausa MP Murari Lal Meena, who resigned as an MLA after his election to Lok Sabha this year, is considered close to Mr. Pilot. With Mr. Pilot pitching in with his support, Congress candidate Deendayal Bairwa is asserting his Dalit identity with the promise to strengthen the marginalised communities and protect their interests.

Interestingly, the general category Assembly seat of Dausa is witnessing a contest this time between the candidates of rival parties belonging to Scheduled Caste and Scheduled Tribe. Addressing a public meeting here on Friday, Pradesh Congress Committee president Govind Singh Dotasra questioned Mr. Kirori Lal’s entry into the fray for his brother despite the ruling BJP’s defeat at 11 seats in this year’s Lok Sabha election in the State.

Amid the stalemate continuing over his resignation, Mr. Kirodi Lal’s reputation seems to be at stake in Dausa. The septuagenarian tribal leader had tendered his resignation as a Minister in July this year, taking responsibility for the BJP’s defeat at four of the seven seats put under his charge. The party’s central leadership is yet to take a decision on the acceptance of his papers.

While the BJP’s decision to give ticket to Mr. Jagmohan has been perceived as a step to mollify the senior Meena leader, his supporters believe that his popularity among both Meena and Gujjar communities would ensure victory for the party. Just before the ticket distribution for the bypolls, Mr. Kirori Lal had reiterated his decision to step down from the State Cabinet.

Babu Singh Khinchi, a party worker from Hanumangarh district, told The Hindu at the BJP’s election office at Somnath Circle here that a large number of people had come from far-off place to join the bypoll campaign solely because of Mr. Kirori Lal’s track record of helping those in need. “Jagmohan Ji does not need to do anything. Kirori Baba’s image is sufficient for him,” he said.

Mr. Jagmohan, who took voluntary retirement from the State government service in 2014 and fought the Lok Sabha election as a Rashtriya Jantantrik Party candidate from Sawai Madhopur, was constantly trying to get the BJP’s ticket for different elections held since then. As he has succeeded this time, he has promised to bring irrigation waters from Eastern Rajasthan Canal Project and develop Dausa as an education hub.

In the Congress camp, senior leaders are confident about the “Dalit card” used in the candidature of Mr. Bairwa. Party in-charge in Sainthal, Ramavtar Meena, said while the Meena votes were expected to be divided equally, the support of Dalits, Muslims and Other Backward Classes would be crucial for the Congress candidate.

Congress leader Rahul Gandhi on Saturday (November 9, 2024) launched a scathing attack on the BJP-led Centre, saying its tax structure is designed to “loot the poor”.

“Indian tax structure is to loot the poor. Adani pays taxes equivalent to you. Dharavi land, worth ₹1 lakh crore, is being handed over to him,” Mr. Gandhi alleged while addressing a rally in Jharkhand’s Dhanbad.

He also took a jibe at Prime Minister Narendra Modi, alleging, “PM Modi travels in seaplanes, goes inside the sea, but the poor and women bear the brunt of price rise.”

Mr. Gandhi further alleged that Scheduled Tribes (STs), Scheduled Castes (SCs), and Other Backward Classes (OBCs) constitute 90% of India’s population, but they are not represented in Government institutions.

“We will give to the poor funds equivalent to the debt of capitalists waived by PM Modi,” said Mr. Gandhi.

DVAC raids Vilangudi Sub-Registrar’s office in Madurai; seizes ₹1.98 lakh

The Directorate of Vigilance and Anti-Corruption (DVAC) seized ₹1.98 lakh in cash from the office of the Sub-Registrar in Vilangudi, Madurai, on Friday (November 8, 2024).

The Sub-Registrar, named Veerakumar, was posted in Vilangudi about 18 months ago, and there were complaints against the official demanding bribes from several people. The DVAC had registered a case against the Sub-Registrar following these complaints 

After surveillance, a police team led by DSP Satyaseelan and Inspectors Suryakala, Ramesh Prabhu, Kumaraguru, and others raided his office premises for nearly five hours on Friday. The search, which began at 5.30 p.m., ended at around 10.30 p.m.

A senior officer from the DVAC said on Saturday (November 9, 2024) that the Sub-Registrar’s driver, who was identified as Kumar, had allegedly been collecting bribes from premises close to the Sub-Registrar’s office. The police also seized cash from the computer section and from a few touts and document writers.

The police also reportedly recorded statements from some of the document writers and their assistants by visiting their offices. The probe revealed that in addition to the staffers, several private/unauthorised persons were also present at the office. Inquiries with them indicated that they were engaged on a ‘contract’ basis due to a shortage of staff.

Further investigation is underway.

No facilities, allege visitors

The public visiting the Sub-Registrar’s office in Vilangudi, meanwhile, complained that the office, which functions from a rented building, lacked infrastructural facilities. With vast jurisdictional coverage, at least 50 to 100 people visited the office everyday, but the seating facilities are poor, they claimed.

The internet facility is also weak, and these issues are not addressed by the officials, the visitors alleged.

The Jharkhand Mukti Morcha and Congress government in Jharkhand has turned the State capital Ranchi into Pakistan’s Karachi, Madhya Pradesh Chief Minister Mohan Yadav said on Friday as he accused the coalition of giving shelter to “Bangladeshi infiltrators”.

Mr. Yadav made the remarks addressing multiple election rallies in poll-bound Jharkhand and accused Chief Minister Hemant Soren’s government of providing facilities to people from Bangladesh in the greed of votes and power. 

“For every government, the security of the country and state is the first, no government gives protection to infiltrators. But it is unfortunate that Congress and Hemant Soren deliberately gave protection to Bangladeshi infiltrators here. In the greed of power and votes, these people have deliberately given protection to Bangladeshi intruders,” Mr. Yadav said at campaign rallies for BJP candidates.

“This is the reason why the Hindu population in Jharkhand reduced from 44 percent in the past to 28 percent now while the Muslim population has increased by four [percentage points]. Our neighbouring country Pakistan is known for loot, lies, fraud and insult of Hindus. The Congress and Hemant Soren government has turned Ranchi into Karachi,” the BJP leader said, claiming a danger to Hindu culture, festivals and future generations if the public did not become alert now. 

His predecessor in Madhya Pradesh, Union Minister Shivraj Singh Chouhan also said at another rally that it was crucial to form a BJP government in Jharkhand and expel the “Bangladeshi infiltrators”. 

“Our sisters and daughters are standing against this dishonest JMM-Congress government. This is to eradicate injustice and terror. We must protect our ‘roti, beti, and maati.’ This support is crucial to forming a BJP government here and expelling Bangladeshi infiltrators,” Mr. Chouhan said.

Meanwhile, Mr. Yadav also made remarks at the Gandhi family calling them the “fake Gandhis” and that the “greed for votes is not letting them leave the surname”.

“When a daughter gets married, her surname changes. But this family is such that even if the daughter goes to her in-laws’ house, she does not change her surname. They are afraid that if the surname is changed, their votes will be lost,” he said, in an apparent attack at Congress general secretary Priyanka Gandhi Vadra. 

Jharkhand is scheduled to go to polls in two phases on November 13 and 20 with the BJP-led NDA is looking to oust the JMM-Congress alliance from power.

कोविड महामारी के दौरान लोग एक ऐसे अदृश्‍य वायरस से पहले ही जूझ चुके हैं जो हवा से फैलता था, संक्रमित करता था और लोगों की जान ले लेता था लेकिन साइबर वर्ल्‍ड से जुड़े एक्‍सपर्ट की मानें तो जिस फोन को आप हाथ में लेकर घूम रहे हैं, अगर थोड़ी सी सावधानी हटी तो उसमें आया वायरस उसे भी ब्‍लास्‍ट कर सकता है. वायरस आपके स्‍मार्टफोन को डिस्‍ट्रॉय कर सकता है और आपको मौत के मुंह तक पहुंचा सकता है.

नई है मुसीबत
दिल्‍ली पुलिस की साइबर सेल से जुड़े जाने-माने साइबर एक्‍सपर्ट किसलय चौधरी ने news18hindi से बातचीत में बताया कि अभी तक आपने फोन पर आए लिंक, मैसेज या ईमेल पर क्लिक करने से आपके सिस्‍टम के हैंग होने, अकाउंट से पैसा गायब होने, आपका फोन हैक होने या निजी सूचनाओं के लीक होने की दिक्‍कतों का सामना करना पड़ रहा था, लेकिन अब जो मुसीबत आ रही है, वह इससे कहीं ज्‍यादा खतरनाक और लेटेस्‍ट है. इसे लेकर साइबर वर्ल्‍ड के लोग भी गहराई से जानकारी जुटा रहे हैं.

फोन में वायरस और फिर ब्‍लास्‍ट
किसलय कहते हैं कि चीन और जापान में कुछ ऐसी घटनाएं सामने आई हैं जिनमें देखा गया है कि एंड्रॉयड हो या आईओएस स्‍मार्टफोन, दोनों में ही पीडीएफ और ईमेल के जरिए ऐसा वायरस भेजा जा रहा है, जिसे खोलते ही वह एक्टिव हो जाता है और आपके फोन को बर्बाद करने के साथ ही उसमें ब्‍लास्‍ट भी कर सकता है. ऐसी स्थिति में सोचिए अगर फोन आपके हाथ में है तो आपका क्‍या होगा?

दो दिन पहले जारी हुई है चेतावनी
चौधरी कहते हैं कि फोन में आने वाले इस तरह के वायरस को लेकर एंड्रॉयड और आईओएस की ओर चेतावनी भी जारी की गई है, जिसमें कहा गया है कि किसी भी अनजान पीडीएफ को न खोलें. यह नुकसानदेह हो सकता है. वहीं दिल्‍ली पुलिस की साइबर सेल ने भी दिल्‍ली और देशभर में आईओएस या एंड्रॉयड फोन इस्‍तेमाल कर रहे लोगों को सचेत किया है.

क्या न करें लोग
किसलय चौधरी कहते हैं कि जो भी लोग स्‍मार्टफोन चला रहे हैं, अगर उन्‍हें उनके नाम से एड्रेस करते हुए, किसी अनजान नंबर से कोई भी पीडीएफ या मेल मिलता है तो भूलकर भी उसे न खोलें. अगर आप उस ईमेल या पीडीएफ को खोलते हैं तो उसके पीछे भेजा जाने वाला वायरस काफी खतरनाक हो सकता है. साइबर ब्‍लास्‍ट या साइबर अटैक का यह तरीका काफी लेटेस्‍ट और मॉडर्न है हालांकि भारत में भले ही ऐसा कोई मामला अभी तक नहीं आया है लेकिन बाहर के देशों में ऐसा सुनने को मिल रहा है. इसलिए सावधानी सबसे बड़ी चीज है.

2000 से ज्यादा गानों को किया कोरियोग्राफ
आपको बता दें कि सरोज खान ने बॉलीवुड में 2000 से ज्यादा गानों को कोरियोग्राफ किया है, जिसमें से ज्यादातर हिट रहे. जैसे हवा-हवाई, एक-दो-तीन और चोली के पीछे क्या है. उनका जन्म 22 नवंबर 1948 को बॉम्बे स्टेट में एक हिंदू परिवार में हुआ था. उनका असली नाम निर्मला नागपाल था। उनके माता-पिता ने फिल्म इंडस्ट्री में काम शुरू करने से पहले उनका नाम निर्मला से बदलकर सरोज कर दिया था, क्योंकि वे नहीं चाहते थे कि उनके रूढ़िवादी परिवार को पता चले कि उनकी बेटी फिल्मों में काम करती है.

14 साल की उम्र में बन गई थीं मां
13 साल की उम्र में सरोज खान ने डांस गुरु बी सोहनलाल से शादी की, जो उस समय 43 साल के थे. 14 साल की उम्र में उन्होंने अपने पहले बच्चे को जन्म दिया. पहले बच्चे के जन्म के बाद सरोज को पता चला कि सोहनलाल पहले से शादीशुदा हैं और उनके चार बच्चे हैं. बाद में, उन्होंने एक बिजनेसमैन सरदार रोशन खान के साथ घर बसाया और उनसे शादी की. शादी के लिए उन्होंने इस्लाम धर्म भी अपना लिया.

In the name of the law | Custodial torture and deaths in Uttar Pradesh

Tapeshwari Devi recounts the night of October 25 with sadness and anger. Her son, Mohit Pandey, 32, had got into a minor dispute with their neighbour, Adesh Kumar, over a few thousand rupees. At 7 p.m., the police arrived and whisked Mohit away to the Chinhat police station in Lucknow.

Mohit, a manufacturer and supplier of school uniforms, had been detained for ‘breaching the peace’ under Section 352 of the Bharatiya Nyay Sahita (BNS), according to the police. When his brother, Shobha Ram Pandey, went to the police station to enquire about Mohit, he was also detained, for being intoxicated.

The next day, a CCTV video, allegedly from the lock-up at Chinhat police station, appeared in the public domain. It showed a man, who relatives say is Mohit, crumpled on the floor. Seven other inmates, including his brother, were seen rubbing his shoulders and shouting for help. At the end of the 77-second video, the inmates beg the police for help and Shobha Ram hands a bottle of water to his brother.

Later that day, Devi’s phone rang. “The caller told me that Mohit had been sent to Ram Manohar Lohia Hospital as his health had deteriorated,” she says, her eyes welling up. Devi rushed to the hospital only to learn that her son was no more.

The medical staff and the police apparently told her that the chief medical superintendent of the hospital, Vikram Singh, had confirmed that Mohit had been brought dead around 3 p.m.

Devi was shocked. “They killed him, and for what? Over such a minor issue,” she says.

Mohit is survived by his mother, wife, and three children. His family staged a protest outside the hospital for two days, claiming that the police had beaten him up, which had led to his death. They said that the police took him to hospital so that the torture that he faced in custody would never be known.

Shobha Ram, who was released the day Mohit died, describes the police station as “filthy” and says they were treated badly. “When I asked for water, the police did not give it to us. They abused us. Mohit’s health deteriorated that night,” he recalls. Shobha Ram alleges that his brother died due to custodial torture.

Devi claims that no action was taken against the neighbour, Adesh. “It was due to the influence of Adesh’s uncle, a political leader, that Mohit underwent such torture,” she alleges.

A dubious distinction for Uttar Pradesh

According to the United Nations, custodial deaths refer to the deaths of individuals while in custody of a law enforcement agency or a court. They represent among the gravest violations of human rights in societies governed by the rule of law. Such deaths may be directly or indirectly associated with events that transpire during the individual’s confinement.

According to data shared by the Government of India in the Lok Sabha in July 2022, Uttar Pradesh ranked first in the number of custodial deaths in 2021-22, recording 501 out of 2,544 such deaths across the country. West Bengal accounted for the second-highest number (257 deaths).

“Many custodial violence cases get buried under the carpet. Only cases that get thrust into the limelight or are scrutinised by the media lead to action or punishment,” says Gajendra Singh Yadav, an anti-torture activist and lawyer, who filed a complaint with the National Human Rights Commission (NHRC) over Mohit’s death.

For instance, in June, a court in Sitapur convicted three police constables for abetment of suicide and illegal detention and awarded 10 years of rigorous imprisonment to each of them in a two decade-old case relating to the custodial death of a Dalit man.

Mohit’s family visited the residence of Chief Minister Yogi Adityanath on October 28. Adityanath directed officials to provide them an ex-gratia compensation of ₹10 lakh, housing, free education for the children, and access to various government schemes. Adityanath, who has repeatedly said that U.P. was an anarchy under the Samajwadi Party government and that he would ensure law and order, also assured the family that those responsible for Mohit’s death would face strict punishment.

Later, Devi registered a First Information Report (FIR) against Ashwani Kumar Chaturvedi, the station house officer of Chinhat; Adesh; and unidentified police personnel under Sections 103(1) (relating to charges of murder) and 61(2) (relating to criminal conspiracy) of the BNS.

Before Mohit, it was Aman

Aman Gautam, 28, used to do electric work for daily wages. His sister, Sudha Gautam, remembers the night of October 11 when he was sitting at Ambedkar Park in Sector 8 of the Vikas Nagar locality in Lucknow. That was the night he died.

The U.P. police said in a statement that following reports of gambling activities, they landed at the park and took him into custody. They claim that while he was on the way to the station, Aman’s condition deteriorated. When he was taken to Lohia hospital, he was pronounced dead.

“He died due to torture by the police in the van. He was severely beaten by them,” Sudha alleges. She describes the incident as a “conspiracy”, as another man, Sonu Bansal, who was taken into custody, was unharmed.

“While we faced a lathi charge when we protested outside the Vikas Nagar police station, no case of murder was registered against the accused police personnel,” she says. They demanded a case be registered relating to murder and criminal conspiracy against the officers. However, a case was registered under Section 105 (culpable homicide not amounting to murder) of the BNS and Sections 3(1)(d) and 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, against four policemen.

The family alleges that while in the Chinhat death case, the government provided compensation, housing, free education, and government benefits to Mohit’s family, they offered little help in Aman’s case despite repeated assurances.

“Only Lucknow East MLA, O.P. Srivastava, provided ₹1 lakh as ‘help’,” Sudha says. “Where will we go? We are Dalit. So, this is the treatment we get,” she says. Sudha is distraught but worries more than anything else about Aman’s four-year-old daughter.

A basket of failures

Mohammad Haider Rizvi, an advocate at the Allahabad High Court and a human rights activist, says there are many reasons for the high number of custodial deaths in U.P.: the “lack of competence of law-enforcement agencies in investigating a crime, the pressure they face from their superiors, and the threats they receive of getting suspended or removed from the field if they do not ‘show results.’” The other reason, he contends, is the “failure of human rights organisations to address the scourge.”

Yadav, the anti-torture activist, says the U.P. government has emboldened the police with the aim of maintaining law and order. This, he believes, has contributed to extra-judicial violence. For instance, just months after coming to power in 2017, Adityanath declared that his government would bulldoze the houses of those who even considered perpetuating crimes against women or against marginalised sections of society. “Such measures lead to a regressive approach by the police in dealing with suspects,” says Yadav.

In the run-up to the Jharkhand Assembly elections, Adityanath appealed to the people to vote in a government that will eradicate the mafia, like the “U.P. model” had. He was welcomed in Koderma, where the rally was held, by 11 bulldozers. He said, “Before 2017, mafia groups roamed freely with pride, but since the bulldozers began their work, even the most notorious people have fled U.P. Mafia groups involved in mining, forests, animals, organized crime, liquor, and land have vanished from the State like horns from a donkey’s head.”

To make matters more difficult for victims and their families, the NHRC and the State Human Rights Commissions (SHRCs) are primarily recommendatory in nature. The NHRC and SHRCs have neither the power to punish violators of human rights nor to award any relief of any kind to victims. Their recommendations are not binding on the government. “These groups have become ornamental organisations and a haven for retired judges and bureaucrats,” believes Rizvi.

Sociologists say a culture of unchecked power within law enforcement is also a factor. “In U.P., the narrative is that the state is extremely powerful and will crush people who do wrong. That mindset is seen in the police force in the State too,” says D.R. Sahu, the head of the sociology department at the University of Lucknow.

Rules and no implementation

In an attempt to curb incidents of custodial deaths and harassment in police custody, U.P. director general of police, Prashant Kumar, issued comprehensive guidelines in July to all district police chiefs and field officers of the State. The guidelines state that an inquiry should be conducted to ascertain an individual’s health status before they are taken to the police station; that a suspect should be brought in for questioning only after the police station in-charge is informed about it; that if a suspect’s health deteriorates in police custody, the entire sequence of events should be photographed and videographed; that medical facilities should be provided to them in such a scenario; and that only an investigation officer or the police station in-charge should interrogate the suspect.

“But the problem is not with the rules,” says Sulkhan Singh, former DGP of U.P. “It is with implementation. India ranks 79 out of 142 in the Rule of Law Index 2024. It was 57 in 2015. This statistic reveals the real picture.” The Rule of Law Index is published every year by the World Justice Project, a Washington-based organisation that works to build awareness and stimulate action to advance the rule of law worldwide.

On some other crime-related parameters too, U.P.’s performance is dismal. In the latest (2022) report of the National Crime Records Bureau (NCRB), the State recorded the highest number of crimes against women (65,743 cases such as rape, murder, kidnapping, murder after rape, and gang rape).

No anti-torture laws

India lacks specific laws against torture. The Prevention of Torture Bill, 2022, tabled in the Lok Sabha by E.T. Mohammad Basheer, aimed to prevent custodial torture and ensure that compensation is awarded to victims and that erring public officials are liable for punishment. “Sadly there is no hope that this will get passed,” says Rizvi.

Critics of the BNS say the police themselves investigate cases of custodial torture, which is why there are such few convictions.

Yadav says he cannot forget the day when Ajay Yadav, a labourer from Jaunpur, visited him in Prayagraj. “He was so broken, he was ready to sell all his ancestral land and cattle to get justice for his brother, who was killed while being tortured by the police,” he says.

The case dates to February 2021 when Ajay’s younger brother, Krishna Yadav alias Pujari Yadav, died. Yadav, the activist, persued the case in the High Court, pushing for a probe by the Central Bureau of Investigation (CBI). He says, “The probe unearthed facts about how the torture of the deceased was planned. Initially, the role of nine police personnel come to the fore; then, more policemen came under the radar. For nine months, the accused escaped the arrest warrant. But then they were arrested and have been in prison for more than a year.” The policemen were booked under various sections of the Indian Penal Code, including 302 (murder).

However, this is an exception and not the norm. Between 2001 and 2020, more than 1,800 people died in police custody across India, but only 26 policemen were convicted, according to the NCRB’s annual Crime in India report.

Although India signed the United Nations Convention against Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment on October 14, 1997, it has not ratified it.

In its 113th report, the Law Commission of India recommended an amendment to the Indian Evidence Act, 1872. It said that in case of custodial injuries, if there is evidence, the court may presume that the injury was caused by the police who had custody of that person during that period. The Supreme Court of India, in the case of Dilip K. Basu v. State of West Bengal and Others (1997), reiterated the concerns relating to custodial interrogation and laid down guidelines for the police. It prohibited the police from using third-degree methods during investigation and interrogation of accused individuals, called for giving the police training and orientation, and emphasised basic human values.

The families of both Aman and Mohit are poor. Sudha says Aman is the fourth sibling she has lost. “I cry for not just his child but also my sister-in-law. She doesn’t have a job. How will she manage? For Dalits like us, the trauma is endless,” she says.
