Madras High Court restrains U.S. citizen from proceeding with divorce plea filed in Washington

The Madras High Court has restrained an American citizen from proceeding with a divorce case filed by her before the King County Superior Court in Washington, United States, and also from initiating any kind of legal proceedings related to her marriage before the courts in Singapore.

Justice V. Lakshminarayanan granted the anti-suit injunction after agreeing with her husband, an Indian citizen, that the Family Court in Chennai would be the right forum to decide on the matrimonial dispute between the couple, who got married in 2013 under the Special Marriage Act of 1954.

After their wedding, the couple had relocated to the United States and had a child in 2016. In 2023, they relocated to Singapore and in 2024, the woman lodged a complaint accusing her husband of assault. Shortly thereafter, he flew down to India and sought divorce on the grounds of cruelty and adultery.

The woman was made one of the respondents to the divorce petition filed before the Family Court in Chennai on September 4, 2024. On September 6, 2024, she too filed a divorce petition before the Washington court though she was residing with her child in Singapore then.

An e-mail written by her to the American Citizen Services at the U.S. embassy in Singapore, seeking a passport for her child, referred to the divorce petition filed by her estranged husband in Chennai and stated that “she needs to submit herself before the courts in India” in order to prevent an ex parte order, the judge pointed out.

On the contrary, she flew to San Francisco with the child on October 14, 2024, just a day before the husband could obtain an injunction order from a court in Singapore restraining her from moving the child outside Singapore. After flying to the U.S., she began pursuing her divorce plea filed in Washington.

Anti-suit injunction application

The husband then moved an anti-suit injunction application before the Family Court in Chennai. When no orders were passed on that application, he filed a civil revision petition before the High Court seeking a direction to the Family Court to dispose of his divorce plea within six months.

The judge said that a direction simpliciter to dispose of the divorce plea at the earliest, without granting any interim relief, might lead to a situation of fait accompli if the petitioner’s estranged wife continues to prosecute the matrimonial disputes before the courts in Washington or Singapore.

Asserting that the power of the High Court, to have superintendence over all trial courts, under Article 227 of the Constitution was very wide, the judge suo motu ordered the transfer of the anti-suit injunction application from the Family Court to the High Court, and allowed it.

Justice Lakshminarayanan agreed with the petitioner’s counsel Geetha Luthra, assisted by Deepika Murali and K. Harishankar, that even if the King County Superior Court at Washington grants divorce at the woman’s instance, it would not be recognised by the courts in India.

Grounds for divorce under SMA

The judge pointed out that the divorce plea before the Washington court had been filed on the ground that the marriage had broken down irretrievably though no such ground finds a place under the provisions of the Special Marriage Act of 1954 for grant of divorce.

“Any decree obtained by invoking that ground will not be recognised in India, which would result in the wasteful expenditure for the parties to continue the litigation in Washington. If divorce is granted in U.S. and the first respondent (petitioner’s wife) were to remarry and subsequently, the courts in India were to refuse to recognise the decree, the consequences will be disastrous,” the judge wrote.

He also said, though Singapore would have been the best place to file the divorce proceedings from the point of view of convenience of both parties, such a plea could not be filed over there due to the legal requirement that the couple must have resided in that country for at least three years.

‘Complete trial by Sept. 2025’

Since the marriage had been solemnised at Villivakkam in Chennai and all evidence as well as witnesses required for the conduct of the trial in the divorce plea were here, the judge directed the Family Court in Chennai to proceed with the trial and complete it before September 30, 2025.

Taking note that the petitioner was a man of means, the judge directed him to pay 30,000 Singapore dollars a month towards maintenance from September 2024 till the disposal of the divorce case. He was also ordered to pay a lump sum of ₹10 lakh towards her litigation expenses.

After making it clear that the Family Court should not insist on physical presence of the woman and permit her to appear through video conference for counselling as well as trial, the judge said, the petitioner must provide her, and the child, business class flight tickets and five-star accommodation if they have to appear in person.

The A.P. Government has constituted a committee of a Group of Ministers (GoM) to visit and study the “free bus travel for women” scheme in the states where it is already being implemented, to evolve a suitable model for Andhra Pradesh state.

The committee is represented by Transport Minister M. Ramprasad Reddy as its Chairman, Minister for Women and Child Welfare and Tribal Welfare Gummadi Sandhya and Home Minister V. Anitha as members.

A Government Order (GO) released to this effect on Saturday (December 21, 2024) said the Principal Secretary, Department of Transport and Road and Buildings would be the convener and he would coordinate the committee proceedings. The GO that the GoM would submit their report at an early date to the government.

Congress slams government

The Congress party has called it ‘delaying tactics’ of the TDP-led coalition government in the State. The Andhra Pradesh Congress Committee (APCC) president Y.S. Sharmila alleged that the coalition NDA government in the state lacked sincerity in implementing the free bus travel scheme for women. “The government is merely procrastinating, citing some excuse or the other,” she posted on X.

“Six months into power, the government has let time slip by citing festivals and celebrations. It had claimed that new buses would be purchased for implementation of the scheme, but now they are dragging the issue further,” she said.

Asserting that there was no need for a massive to implement “such a small scheme”, she pointed to the scheme being implemented by the Congress governments in the neighbouring Telangana and Karnataka states. Both the states had executed the scheme within a week of coming to power, she said.

Ms. Sharmila questioned Chief Minister N. Chandrababu Naidu’s failure to allocate monthly funds to the tune of ₹300 crore to the A.P. State Road Transport Corporation (APSRTC) under zero-ticket reimbursement and demanded that the government implement the scheme immediately as a “New Year’s” gift to the women in the State.

Girl student bitten by snake in classroom; Kerala govt orders probe

The Kerala government on Saturday (December 21, 2024) ordered an inquiry into the incident of a girl student being bitten by a snake inside a classroom of an aided school at Neyyattinkara, Thiruvanathapuram.

A Class VII student was reportedly bitten by a venomous snake during Christmas celebrations at the upper primary school on Friday (December 20, 2024).

Condition stable

She was soon rushed to the nearby government hospital and her condition is stable now, sources said.

In a statement issued on Saturday, General Education Minister V. Sivankutty said instructions have been given to the Director of General Education to carry out a probe into the incident and submit a report at the earliest.

India’s green cover increased by 1,445 sq km from 2021 to 2023: Government report

India’s total forest and tree cover has increased by 1,445 sq km since 2021, reaching 25.17% of the total geographical area in 2023, according to the latest government data.

The India State of Forest Report (ISFR) 2023, released on Saturday (December 21, 2024), also said that India has achieved an additional carbon sink of 2.29 billion tonnes compared to 2005 levels.

As part of its climate plans or Nationally Determined Contributions (NDCs) to meet the Paris Agreement goals, the country has committed to creating an additional carbon sink of 2.5 to 3 billion tonnes through additional forest and tree cover by 2030.

The country’s total forest cover increased to 7,15,343 sq km in 2023, reaching 21.76% of its geographical area, the report stated.

The tree cover increased by 1,289 sq km and now constitutes 3.41% of the country’s geographical area, it said.

Together, the forest and tree cover amount to 8,27,357 sq km or 25.17% of India’s geographical area. This marks an overall increase of 1,445 sq km from 2021, with forest cover alone rising by 156 sq km.

According to the Forest Survey of India (FSI), forest cover refers to all land that has a tree canopy density of more than 10% and spans over an area of one hectare or more, regardless of the type of ownership or legal status.

This includes natural forests as well as man-made plantations, orchards and tree patches in urban and rural areas that meet the size and canopy density criteria.

Tree cover is defined as patches of trees and isolated trees outside the Reserved Forest Area (RFA) that are less than one hectare.

Environment Minister Bhupender Yadav said the most positive finding of the report is that India has already created an additional carbon sink of 2.29 billion tonnes compared to 2005 levels.

India’s carbon stock in 2023 is estimated at 7,285.5 million tonnes, which is an increase of 81.5 million tonnes compared to 2021.

The fast-growing South Asian country is estimated to have 31.71 billion tonnes of carbon stock in forest and tree cover by 2030.

FSI Director General Anoop Singh said bamboo cover has also been estimated and included in the tree cover.

India’s total bamboo-bearing area is now estimated at 1,54,670 sq km, an increase of 5,227 sq km compared to 2021.

Among states, Chhattisgarh (+684 sq km), Uttar Pradesh (+559 sq km), Odisha (+559 sq km) and Rajasthan (+394 sq km) recorded the highest increases in combined forest and tree cover.

For forest cover alone, the largest gains were seen in Mizoram (+242 sq km), Gujarat (+180 sq km) and Odisha (+152 sq km).

In terms of the total area, Madhya Pradesh leads with the largest forest and tree cover (85,724 sq km), followed by Arunachal Pradesh (67,083 sq km) and Maharashtra (65,383 sq km).

For forest cover specifically, Madhya Pradesh remains on top (77,073 sq km), followed by Arunachal Pradesh (65,882 sq km) and Chhattisgarh (55,812 sq km).

When considering forest cover as a percentage of the geographical area, Lakshadweep ranks first (91.33%), followed by Mizoram (85.34%) and Andaman & Nicobar Islands (81.62%).

The FSI also analysed forest cover changes in the Western Ghats and Eastern States Area (WGESA) over the past decade and found an overall loss of 58.22 sq km in forest cover.

During this period, very dense forests increased by 3,465.12 sq km while moderately dense forests and open forests decreased by 1,043.23 sq km and 2,480.11 sq km respectively.

In the hill districts of the country, the forest cover is 2,83,713.20 sq km, which makes up 40% of the total geographical area of these districts. The latest assessment shows an increase of 234.14 sq km in forest cover in hill districts.

The latest ISFR report showed a decrease of 327.30 sq km in forest cover in the northeastern region.

The total forest and tree cover in the region stands at 1,74,394.70 sq km, accounting for 67% of the region’s geographical area.

The country’s total mangrove cover stands at 4,991.68 sq km, a net decrease of 7.43 sq km since 2021, according to the report.

Moderately dense forest and open forest categories saw declines of 1,043.23 sq km and 2,480.11 sq km, respectively, over the last decade, despite gains in very dense forest, the report stated.

The FSI has been assessing forest cover since 1987 and tree cover since 2001.

The National Forest Policy 1988 mandates that 33% of the geographical area of India should be under forest or tree cover.

DMK calls for rescheduling of UGC-NET exam

DMK Students’ Wing Secretary and Kancheepuram MLA C.V.M.P. Ezhilarasan called for the rescheduling of University Grants Commission-National Eligibility Test (UGC-NET) exams, which are slated to be held on January 15 and 16, during Pongal holidays.

In a statement on Friday (December 20, 2024), he alleged that the Union government was insulting Tamil Nadu’s traditions and sentiments by conducting the exams at the same time as the Pongal festival. He also warned that the party would stage protests if the exams were not rescheduled.

Maharashtra Opposition leaders protest against fake medicine scam

The Opposition protested on Saturday (December 21, 2024) on the premises of Vidhan Bhavan in Nagpur over an alleged fake medicines supply scam in government hospitals in Maharashtra.

Opposition members held placards and raised slogans against the Mahayuti government on the steps of the State Legislature on the last day of the Winter Session.

“One-and-a-half years ago, fake medicines were supplied to patients in medical colleges and government-run hospitals. However, no action was taken against any minister or official,” Leader of the Opposition in the legislative council Ambadas Danve alleged.

Maharashtra Congress president Nana Patole, Vijay Waddetiwar, Shiv Sena (UBT) MLA Varun Sardesai and other legislators joined the demonstration.

ADMK Workers’ Rights Retrieval Committee coordinator O. Panneerselvam on Friday (December 20, 2024) alleged that firms, whose samples for tur dal (thuvaram paruppu) and palm oil did not pass the quality check, had been chosen by the State Civil Supplies Corporation on account of “pressure exerted from the top.”

In a statement, he referred to the tender floated by the Corporation for the procurement of 60,000 tonnes of tur dal andsix crore litres of palm oil, and sought the intervention of Chief Minister M.K. Stalin in the matter.

Association urges DMS to conduct counselling to fill civil surgeon posts

The Service Doctors and Post Graduates Association (SDPGA) has urged the Directorate of Medical and Rural Health Services (DMS) to conduct the transfer and promotion counselling for the posts of Chief Civil Surgeons (CCS) and Senior Civil Surgeons (SCS). The delay in promoting the doctors — two batches of 2023 and 2024 — has led to administrative stagnation, with many posts of CCS remaining vacant in government hospitals under the directorate.

P. Saminathan, president of SDPGA, in a letter to the Director of Medical and Rural Health Services, urged the DMS to conduct the transfer and promotion counselling for 2023 and 2024 panels (a seniority list of doctors eligible to be promoted) for CCS and SCS.

He said the delay in promoting the doctors from the cadre of civil surgeons to SCS and from SCS to CCS has led to administrative stagnation, with many posts of CCS remaining vacant; in many hospitals, the posts of Chief Medical Officers were being managed on an in-charge basis. “The two panels are pending. If the promotions were given on time, more doctors could have become CCS. All government hospitals under DMS should be headed by a CCS.”
